A Hybrid within a Hybrid: Contextualising REACH in the Process of European Integration and Constitutionalisation
REACH is a new European Community Regulation on chemicals and their safe use. This Regulation is a hybrid that combines hierarchy and heterarchy from a both a legal and an organisational perspective.
Such hybridism is, however, not a feature that is particular to REACH. Rather the EU itself must be understood as a hybrid, thereby making REACH a hybrid operating within a hybrid. The hybrid structure of REACH reflects its societal function, which is to simultaneously separate and combine politics, science, economy, health and the environment within a single legal framework. The legitimacy of REACH reflects its hybrid structure in the sense that it is based on a combination of democratic, procedural and deliberative components.

The present publication is a multi-jurisdictional overview on recent legal developments with regard to product liability risks for companies from the Chemicals industry. This combined effort was undertaken by various members of the Hogan Lovells Global Chemicals Product Liability Industry group. This two-part publication will in its first part focus on recent developments in Germany, the UK, Italy and France. Mit der seit Mitte 2007 nach langjährigen Diskussionen und zähen Verhandlungen in Kraft getretenen REACHVerordnung (EG) Nr. 1907/2006 wurde eine grundlegende Neuregelung der bisherigen Stoffpolitik in Europa eingeleitet. Nach dem Prinzip „no data, no market“ dürfen innerhalb des Europäischen Wirtschaftsraums nur noch chemische Stoffe in Verkehr gebracht werden, die vorher dort registriert worden sind.

Gemäß Artikel 6 Abs. 3 der FFH-Richtlinie ist eine Prüfung der Verträglichkeit von Plänen und Projekten mit den Erhaltungszielen eines Natura 2000-Gebietes erforderlich, soweit derartige Pläne und Projekte geeignet sein könnten, einzeln oder im Zusammenwirken mit anderen ein entsprechendes Gebiet erheblich zu beeinträchtigen. Diese Vorgaben wurden mit § 34 BNatSchG auf Bundesebene und mit § 26 d BbgNatSchG im Land Brandenburg umgesetzt.
