Groundwater Risk Evaluation of Several Landfill Sites in the Province of Vicenza (Veneto Region, Northern Italy)
© NMC Ltd. (10/2010)
A study on environmental conditions of a large number of landfills, in which waste storage has occurred in '70-'80s, has begun on behalf of the Province of Vicenza. The main purpose of the work, resumed on this paper, is to draw up an inquire priority list and, subsequently, to design monitoring networks in order to test groundwater chemical conditions. Based on the results, a site-specific risk analysis for the groundwater shall be performed. The identified sites are a total of 43, distributed throughout the Province of Vicenza. Site locations are shown in the table enclosed to this paper.

Hazard v. Risk in EU Chemicals Regulation
© Lexxion Verlagsgesellschaft mbH (9/2010)
Hazard is the potential of something to cause harm; risk is the likelihood of harm occurring. Chemicals regulation is largely focused on minimising risks associated with chemicals – and rightly so.

Putting Risk Management to the Test or Why it is Ineffectual to Separate Risk Assessment from Risk Management: The Story of Maximum Levels for Aflatoxins
© Lexxion Verlagsgesellschaft mbH (6/2010)
This article reviews the policy process of setting maximum levels for aflatoxins by the European Union and the Codex Alimentarius Commission. The differences between the two regulatory organizations and the difficulties entailed in the alignment of the two standards are illustrative of the problems inherent in risk analysis in the food sector. This case is also instructive with respect to the way in which scientific evidence is used when deciding on appropriate food safety standards.

Nanomaterials under REACH: Legal Aspects

Unless and until REACH is adapted to more specifically regulate nanomaterials, is there scope for national measures to regulate these materials?

What REACH can teach us about TSCA: Retrospectives of America’s Failed Toxics Statute
© Lexxion Verlagsgesellschaft mbH (3/2010)
Comparative risk assessments in the chemical safety field sometimes adopt a lofty view of the purposes of legislation. This personal essay is not lofty, and it is not just another professor’s comparison of the purposes of the European Union’s REACH with American regulatory programmes.

If in Doubt, Leave it Out? EU Precaution in WTO Regulatory Space
© Lexxion Verlagsgesellschaft mbH (3/2010)
This article reviews the way in which the concept of precaution, as commonly referenced in EU law, is received in the WTO. It argues that precaution is not a principle, but one facet of a principle of making rational judgments based on available information, the other facet of which is “that risk is worth taking”.

Foundations of Risk Regulation: Science, Decision-Making, Policy Learning and Institutional Reform
© Lexxion Verlagsgesellschaft mbH (3/2010)
The long subtitle of this paper, appearing in the first issue of the EJRR – a publication which fills a serious gap in the scholarly literature of the old continent – identifies what I take to be the key terms of the current debate on risk regulation.

REACH: Use of full study reports for registration purposes – Legitimate possession and reference rights according to Article 10 of REACH
© Lexxion Verlagsgesellschaft mbH (7/2009)
The REACH Regulation includes various obligations for cooperation between registrants. In particular, REACH relies on the principle of data sharing. Registrants are obliged to cooperate with each other to some degree. In certain situations they have to provide each other with substance-specific data available in their own companies. The various items of information can be gathered and used for registration purposes. The main objective of the relevant rules is to avoid duplication of vertebrate animal tests. Furthermore, cooperation – which includes the described form of data sharing – can reduce costs for registrants.
